Age restrictions – supply of alcohol
We are not permitted by law to supply alcohol to anybody under 18 years of age in the UK. By placing an order the purchaser confirms that they are over 18 years of age. If there is any doubt then our delivery drivers and third party couriers may request age indentification from the purchaser or recipient and if they are not satisfied that they are over the legal age to buy alcohol then they will not leave your order.
Copyright, trademarks, software and content
All copyright, trademarks, and any other intellectual property rights and the content on this website, such as website design, text, graphics, images, underlying source code, software and all other material on this website is the sole property of Westerham Brewery Co. Ltd.
Any use, including copying, reproduction, duplication, transmission or display of content of this website without the express written permission from Westerham Brewery Co. Ltd, for purposes other than the viewing of information or for ordering purposes, is strictly prohibited.
You are permitted to print and download extracts from this website for your own use on the following basis:
- no documents or related graphics on this website are modified in any way
- no graphics on this website are used separately from accompanying text
- any of our copyright and trade mark notices and this permission notice appear in all copies
When you place an order, you will receive an acknowledgement email confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be made until we send you confirmation by email that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation email sent at the time of dispatch will be included in the contract.
For the avoidance of doubt, any such contract will be deemed to have been concluded in the United Kingdom. Further, any such contract will be interpreted, construed and enforced in all respects in accordance with the laws of England and the Purchaser and the Company irrevocably submit to the non-exclusive jurisdiction of the English Courts.
Cancellation and Returns Policy
If you wish to cancel your order: you can notify us by email to email@example.com before we have dispatched the goods to you.
Where goods have already been dispatched to you, you can return goods for any reason at any time within 7 days of receipt for a full refund or exchange. The costs of returning goods to us shall be borne by you.
Upon receipt of the goods we will give you a full refund of the amount paid.
The rights to return the goods to us as will not apply in the following circumstances:
- in the event that the product has been used
- any products that we have made specifically for you including draft beer products filled to order such as minicasks, minipins and firkins
- products that by their nature have a limited lifespan, such as minicasks, minipins or firkins and all bright beer.
We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise; please let us know if you have any complaints or comments.
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
We will use our best endeavours to deliver goods promptly but cannot accept any liability for delay in delivery for any cause. Please ensure there will be someone available to sign for the package when it arrives. Standard UK delivery is 5 working days.
All orders received by us are shipped subject to availability. We reserve the right to ship products at a later date, up to 28 days after purchase, where the product ordered is not in stock at the time of purchase. In this situation you will be contacted and offered a full refund instead of delivery of the product.
We cannot be held responsible for disruption to shipping caused by industrial disputes or action outside our direct control. If such disruption occurs you will be offered delivery via an alternative delivery or fulfilment company or a full refund.
Prices and VAT
All prices quoted on this website are inclusive of VAT at the current rate. Prices are subject to change without notice and VAT is applied at the prevailing rate which may change from time to time.
Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this website.
While we endeavour to ensure that the information on this website is correct, we do not warrant the accuracy and completeness of the material. We may make changes to the material on this website, or to the products and prices described in it, at any time without notice. The material on this website may be out of date, and we make no commitment to update such material.
The material on this website is provided “as is” without any conditions, warranties or other terms of any kind. Indemnity and Liability
The company shall not be liable for loss or damages of any kind, including without limitation special or consequential damages, arising out of your access to, or inability to access, this site or your use of, or reliance upon, this site or the content hereof or for negligence (except for personal injury or death) and excludes any such liability to the fullest extent permitted by law.
You agree to indemnify, defend and hold harmless Westerham Brewery Co. Ltd, its directors, employees, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use this website or your breach of the Terms and Conditions.
Nothing in these Terms and Conditions shall exclude or limit our liability for (i) death or personal injury caused by negligence; (ii) fraud; (iii) misrepresentation as to a fundamental matter; or (iv) any liability which cannot be excluded or limited under UK law.
